In accordance with the current data protection legislation, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter, GDPR), as well as Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights (hereinafter, LOPD-GDD), the user is informed in accordance with the provisions of Articles 13 of the GDPR and 11 of the LOPD-GDD:

II. PURPOSE

For what purpose will we process your personal data?

FURIOUS KOALAS SL processes your information for:

  1. Maintaining the commercial relationship and providing the contracted service.
  2. Creating a quote tailored to your needs.
  3. Managing email communications with interested parties.
  4. Carrying out the company’s selection processes.
  5. Managing the company’s employees and human resources.
  6. Monitoring the security of the facilities (video surveillance).
  7. Managing training activities.

How long will we keep your data?

The personal data you provide us will be retained as long as the commercial relationship is in force. However, to maintain maximum transparency with you, we indicate that the general timeframes we work with are:

  • Generic identification data (email, name, surname, phone, etc.): as long as the commercial relationship lasts or until consent is revoked. In any case, they will be deleted when they are no longer needed for the purpose they were collected.
  • Accounting, fiscal, and labor: six (6) years.
  • Labor: ten (10) years.
  • Selection processes: two (2) years from the submission of the curriculum.
  • Video surveillance: thirty (30) days, unless recording an infraction and/or crime.

Despite these general timeframes, we inform you that we will periodically review our systems to delete data that are not legally necessary.

What is the legitimacy for processing your data?

According to the purposes of the data collection, the processing of your data is necessary for:

  1. Managing the commercial relationship you have subscribed to and contracted with us.
    1. Execution of a contract (enabled by Article 6.1.b GDPR).
    2. Consent of the interested party (enabled by Article 6.1.a GDPR).
  2. Creating a quote tailored to your needs.
    1. Execution of a contract and/or pre-contractual relationship (enabled by Article 6.1.b GDPR).
  3. Managing email communications with interested parties.
    1. Consent of the interested party (enabled by Article 6.1.a GDPR).
    2. Legitimate interest (enabled by Article 6.1.f GDPR).
  4. Carrying out the company’s selection processes.
    1. Consent of the interested party (enabled by Article 6.1.a GDPR).
  5. Managing the company’s internal employees and human resources.
    1. Contractual execution (enabled by Article 6.1.b GDPR).
  6. Monitoring the security of the facilities (video surveillance).
    1. Legitimate interest (enabled by Article 6.1.f GDPR).
  7. Managing training activities.
    1. Execution of a contract (enabled by Article 6.1.b GDPR).
    2. Consent of the interested party (enabled by Article 6.1.a GDPR).

Additionally, all collected data are necessary for the provision of the service. However, data marked with an asterisk (*) are mandatory. If the mandatory data are not provided, FURIOUS KOALAS SL will not be able to provide the contracted service.

IV. RIGHTS OF INTERESTED PARTIES

What rights do I have in terms of data protection?

In accordance with Articles 13 GDPR and 11.2.c) LOPDGDD, you can exercise any of the following rights by contacting us at the postal address PASEO DE LA UNIVERSIDAD 4 13701 CIUDAD REAL or at the email address INFO@MARSHALMANAGER.COM. In any case, under current regulations, you have the following rights as stipulated in Articles 15 to 22 GDPR and 12 to 18 LOPDGDD:

  • Right to request access to personal data concerning the interested party.
  • Right to request its rectification or deletion.
  • Right to request the limitation of its processing.
  • Right to object to the processing.
  • Right to data portability.

You can request the forms to exercise your rights from the Data Controller through the email address provided in the contact details of the data controller. Additionally, you can file a complaint with the Spanish Data Protection Agency (AEPD). More information is available in Section VII of this document.

V. RECIPIENTS

To which recipients will your data be communicated?

You will always be informed and, where appropriate, your express consent will be requested to transfer your personal data or carry out international transfers in accordance with current regulations (arts. 13.1.e) and 44 GDPR, as well as art. 11.1 and 40 LOPDGDD 3/2018).

VI. SOURCE OF YOUR DATA

How have we obtained your data?

The personal data used by FURIOUS KOALAS SL come from the interested party, thus complying with the provisions of Articles 13 GDPR and 11 LOPDGDD mentioned above, or from group or partner companies, about which you can obtain more information by writing to the email address INFO@MARSHALMANAGER.COM or at the Data Controller’s office at the postal address indicated in this document.

What categories of data do we handle?

The categories of personal data processed:

  • Identification data
    • Name
    • Surname
    • Email address
    • Contact phone number (mobile / landline)
  • Location data: Marshal Mate requires access to your location while you are using it to display your current position on the golf course map, help you locate holes, and provide navigation on the course.
    • Latitude & Longitude

The processing of sensitive data will be carried out in accordance with Articles 9 GDPR and 9 LOPDGDD, always informing the interested party about which data will be used by the data controller.

VII. SUPERVISORY AUTHORITY

At FURIOUS KOALAS SL, we strive to comply with data protection regulations as it is our most valuable asset. However, we inform you that if you believe your rights have been violated, you can file a complaint with the Spanish Data Protection Agency (AEPD), located at C/ Jorge Juan, 6. 28001 – Madrid.
